Welcome to The Card Shelf Workshop! Throughout the site, the terms "we", "us" and "our" refer to The Card Shelf Workshop. The Card Shelf Workshop operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with an online shopping experience (the "Services"). The Card Shelf Workshop is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully. By visiting, interacting with, or purchasing from our Services, you explicitly agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you are strictly prohibited from using or accessing our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To purchase any products or services we offer, you must provide correct, current, and complete billing, payment, and shipping information. You represent and warrant that you have all legal rights necessary to use the payment method provided. You are solely responsible for maintaining the security of your account credentials and for all activities that occur under your account.

SECTION 2 - CUSTOM 3D-PRINTED PRODUCTS & MANUFACTURING VARIATIONS

All items sold on our website are custom, made-to-order products manufactured using advanced additive manufacturing (3D printing) technologies. Because of the unique technical nature of 3D printing and digital imaging:

  • 3D Printing Artifacts & Imperfections: By purchasing, you acknowledge and agree that 3D-printed items naturally exhibit minor cosmetic and structural characteristics inherent to the production process. Visible layer lines, minor surface artifacts, small extrusion seams, slight surface blemishes, or variations in material texture are normal characteristics of the manufacturing process and do not constitute a defect, error, or damaged item. Every piece is unique, and minor cosmetic inconsistencies will not be considered grounds for a replacement, refund, or return.

  • Visual & Color Variations: We make every effort to display product colors and textures as accurately as possible. However, filament batches can vary slightly, and we do not guarantee that your device’s screen display will accurately reflect the exact physical color or sheen of the final material.

  • Expectation Disclaimer: We do not warrant that the cosmetic finish or physical quality of any products, services, information, or other material purchased or obtained by you will meet your subjective expectations. All product descriptions and pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time.

SECTION 3 - STRICT NO-CANCELLATION & ORDER POLICY

When you place an order, you are making an irrevocable offer to purchase. The Card Shelf Workshop reserves the right to accept or decline your order for any reason at our sole discretion.

Because our products are entirely custom-made to order, ALL SALES ARE FINAL. Production begins immediately upon payment processing. Absolutely no cancellations, modifications, returns, replacements, or exchanges will be accepted for any reason once an order is placed, except strictly as outlined in our written Refund Policy.

We reserve the right to limit sales or quantities to any person, geographic region, or jurisdiction on a case-by-case basis. You represent and warrant that your purchases are for personal use only and not for commercial resale, distribution, or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. Posted prices do not include taxes, shipping, handling, customs, or import charges, all of which are the sole responsibility of the buyer. You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorized to use the payment method; (iii) charges incurred by you will be honored by your financial institution; and (iv) you will pay all posted charges, including applicable shipping fees and taxes.

SECTION 5 - CARRIER TRANSIT AND TRANSFER OF RISK

The Card Shelf Workshop is not liable for shipping delays, losses, or delivery failures. All delivery windows provided are estimates only and are absolutely guaranteed to be non-binding. We are not responsible for delays or damage caused by shipping carriers, customs processing, weather, or events outside our control. Once we transfer the product to the shipping carrier, the legal title and all risk of loss or damage passes entirely to you, the customer. Any claims for items lost or broken in transit must be made by you directly to the shipping carrier.

SECTION 6 - INTELLECTUAL PROPERTY AND DESIGN RIGHTS

Our Services, including but not limited to all trademarks, brand names, custom product designs, physical configurations, utility concepts, text, displays, images, graphics, logos, video, and audio, are the exclusive property of The Card Shelf Workshop, its affiliates, or its licensors, and are fully protected by United States and international patent, copyright, trademark, and trade secret laws.

These Terms permit you to use the Services for personal, non-commercial use only. You are strictly prohibited from replicating, cloning, reverse-engineering, distributing, modifying, or creating derivative works of our physical products, custom designs, or website content without our express, prior written consent. All rights not expressly granted herein are strictly reserved by The Card Shelf Workshop.

SECTION 7 - THIRD-PARTY TOOLS & LINKS

We may provide access to third-party tools or include hyperlinks to third-party websites which we neither monitor nor control. You acknowledge and agree that we provide access to such tools and links "as is" and "as available" without any warranties, endorsements, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools or your interactions with third-party websites.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

The Card Shelf Workshop is powered by the Shopify e-commerce platform. However, any sales, contracts, and purchases you make are directly and exclusively between you and The Card Shelf Workshop. You acknowledge and agree that Shopify is not responsible for any aspect of any sales, products, or services. You hereby expressly release Shopify and its affiliates from all claims, damages, liabilities, or injuries arising from or related to your transactions with The Card Shelf Workshop.

SECTION 9 - PRIVACY & DATA USE

All personal information collected through the Services is governed by our Privacy Policy. Because our store is hosted by Shopify, your data will be transmitted to and processed by Shopify in accordance with their standard processing protocols to complete your transaction.

SECTION 10 - USER SUBMISSIONS AND FEEDBACK

If you submit or post any ideas, suggestions, reviews, photographs, or product feedback (collectively, "Feedback"), you grant us an unrestricted, perpetual, worldwide, irrevocable, royalty-free license to use, reproduce, modify, publish, and display such Feedback in any medium for any purpose, including commercial marketing, without compensation or obligation to you. You warrant that you own all rights to your Feedback and that it does not infringe upon the rights of any third party.

SECTION 11 - ERRORS AND INACCURACIES

Occasionally there may be information on our store that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

 

SECTION 12 - PROHIBITED USES

You are strictly prohibited from using the site, its content, or our products: (a) for any unlawful purpose; (b) to infringe upon or violate our intellectual property rights or the rights of others; (c) to harvest or track personal information; (d) to upload malicious code or viruses; (e) to harass, abuse, or defame our business or employees; or (f) to use automated scrapers, data-mining robots, or artificial intelligence agents to crawl, extract, or interact with the Services without our explicit written permission. A breach of this section results in immediate termination of your access to our Services.

SECTION 13 - COMPLIANCE FOR AUTOMATED AGENTS

Any software, bot, or automated agent accessing the Services must clearly identify itself in the HTTP user-agent string as "Agent/[Name]" and must not attempt to circumvent CAPTCHAs, human-verification protocols, or security parameters. Automated crawling or interacting with our storefront for commercial indexing or competitive pricing analysis without a written license agreement is strictly forbidden.

We reserve the absolute right to terminate this agreement, your account, or your access to the Services at any time, without notice, for any conduct that we determine violates these Terms or is harmful to our business interests. All provisions which by their nature should survive termination (including Intellectual Property, Warranty Disclaimers, Indemnification, and Limitations of Liability) shall survive.

THE SERVICES AND ALL PRODUCTS DELIVERED TO YOU THROUGH THE SERVICES ARE PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE CARD SHELF WORKSHOP DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SECTION 16 - TOTAL LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL THE CARD SHELF WORKSHOP, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES. THIS INCLUDES, BUT IS NOT LIMITED TO, ANY VALUE ATTRIBUTED TO COLLECTIBLE CARDS, MEMORABILIA, SLABS, OR ACCUMULATED ITEMS DISPLAYED, STORED, OR USED IN CONJUNCTION WITH OUR PRODUCTS. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE EXACT DOLLAR AMOUNT YOU PAID US FOR THE SPECIFIC ORDER GIVING RISE TO THE LIABILITY.

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless The Card Shelf Workshop, Shopify, and our affiliates, partners, officers, directors, employees, and contractors from any losses, liabilities, damages, claims, and expenses, including reasonable attorneys' fees, made by any third party due to or arising out of: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your misuse of our products or Services.

SECTION 18 - SEVERABILITY & INTEGRATION

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed. Such determination shall not affect the validity and enforceability of any other remaining provisions. These Terms constitute the entire agreement between you and us.

SECTION 19 - MANDATORY GOVERNING LAW & COURT VENUE

These Terms of Service, your use of the website, and any separate purchase agreements whereby we provide you products or Services shall be governed by, interpreted, and construed exclusively in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

Any legal suit, action, purchase dispute, chargeback arbitration, or judicial proceeding arising out of or related to these Terms or products purchased from us MUST be instituted exclusively in the state or federal courts located in DuPage County, Illinois. You hereby irrevocably and unconditionally consent and submit to the exclusive personal jurisdiction and venue of such courts.

SECTION 20 - CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to modify, update, or replace any part of these Terms of Service by posting updates to our website. Your continued use of or access to our website following the posting of any changes constitutes binding legal acceptance of those modifications.
